Welcome to Aura for Creators ("we," "our," or "us"). We are an unregistered partnership operated by independent creators based in Glasgow, Scotland, United Kingdom. We are planning to incorporate as a limited company in 2025.

These Terms and Conditions ("Terms") govern your use of our website at auraforcreators.com and our AI image generation services. By accessing or using our Service, you agree to comply with and be bound by these Terms.

These Terms should be read in conjunction with our Privacy Policy, which explains how we collect, use, and protect your personal information.

IMPORTANT: If you do not agree with any part of these Terms, you must not access or use our Service.

2. Definitions

"Service" refers to the Aura for Creators website and AI image generation platform.

"Credits" refers to the digital currency used to generate images through our Service.

"Third-Party Services" refers to external services we use, including but not limited to Higgsfield AI API, Stripe, and Supabase.

3. Eligibility and Account Registration

3.1 Age Requirement

You must be at least 16 years old to use our Service. We do not verify age through ID checks, but by using our Service, you represent and warrant that you meet this age requirement.

3.2 Account Registration

• You must provide accurate, current, and complete information during registration

• You are responsible for maintaining the confidentiality of your account credentials

• You are responsible for all activities that occur under your account

• You must notify us immediately of any unauthorized use of your account

4. Service Description

4.1 AI Image Generation

We provide an AI-powered image generation service that allows users to create images based on text prompts using credits purchased through our platform.

4.2 Third-Party Dependency

Our Service relies on third-party AI providers, primarily Higgsfield AI API. Service availability, content policies, and technical capabilities are subject to these third-party services.

4.3 Service Availability

We strive to maintain Service availability but do not guarantee uninterrupted access. We may suspend or modify the Service for maintenance, updates, or due to third-party service limitations.

5. Intellectual Property Rights

5.1 AI-Generated Images

Ownership: We do not claim ownership of images generated through our Service. Ownership and usage rights are determined by our third-party AI provider (Higgsfield AI) and applicable intellectual property laws.

Commercial Use Rights: Subject to Higgsfield AI's terms and applicable laws, users generally receive commercial usage rights to generated images. This includes the right to:

• Use generated images for commercial purposes

• Sell, license, or distribute generated images

• Modify or create derivative works from generated images

• Use images in marketing, advertising, or promotional materials

No Attribution Required: You are not required to provide attribution to Aura for Creators when using generated images.

User Responsibility: You are solely responsible for ensuring that:

• Your prompts do not infringe third-party intellectual property

• Your use of generated images complies with applicable laws

• Generated images do not violate rights of identifiable persons

• Your commercial use complies with relevant advertising standards

Third-Party Terms: Your rights are also subject to Higgsfield AI's terms of service. We recommend reviewing their current terms for any additional restrictions or requirements.

No Warranty: We make no representations or warranties about the originality, ownership, or intellectual property status of generated images.

5.2 User Input and Prompts

Your Ownership: You retain all rights to text prompts, descriptions, and other content you submit to our Service.

Limited License to Us: By using our Service, you grant us a non-exclusive, worldwide, royalty-free license to process your prompts through our third-party AI providers solely for the purpose of providing the Service to you.

Data Processing: Information about how we handle your prompts and personal data is detailed in our Privacy Policy.

5.3 Our Platform and Content

Our Ownership: All content on our website, including text, graphics, logos, user interface, software, and design elements, is owned by Aura for Creators or our licensors and is protected by copyright, trademark, and other intellectual property laws.

Limited Use License: We grant you a limited, non-exclusive, non-transferable license to access and use our platform solely for its intended purpose as an end user.

Restrictions: You may not copy, modify, distribute, reverse engineer, or create derivative works from our platform or content without our express written permission.

5.4 Third-Party Intellectual Property

You are solely responsible for ensuring that your use of our Service, including the prompts you submit and the images you generate, does not infringe upon the intellectual property rights of third parties. We are not responsible for any intellectual property infringement claims arising from your use of the Service.

6. Acceptable Use Policy

6.1 Permitted Use

You may use our Service only for lawful purposes and in accordance with these Terms. You are responsible for ensuring your use complies with all applicable laws and regulations.

6.2 Aura Content Standards

In addition to our third-party provider's policies, Aura for Creators maintains the following content standards. You agree not to use the Service to:

Legal Compliance:

• Violate any applicable laws or regulations

• Generate content that would be unlawful in the UK or your jurisdiction

• Engage in activities that could expose us to legal liability

Intellectual Property Respect:

• Infringe upon copyrights, trademarks, or other intellectual property rights

• Generate images that closely mimic copyrighted works without permission

• Create content that violates personality rights or image rights

Platform Security:

• Attempt to circumvent our content filtering or safety measures

• Distribute malware, viruses, or other harmful code

• Attempt to gain unauthorized access to our systems or other users' accounts

• Engage in activities that could disrupt or damage our Service

6.3 Commercial Use Authorization

Commercial use of generated images is generally permitted subject to the intellectual property rights detailed in Section 5. No separate authorization from Aura is required for commercial use of generated content.

6.4 Content Moderation and Reporting

We are committed to maintaining a safe and lawful platform. We employ content filtering and monitoring systems to prevent misuse of our Service.

Reporting Violations: Users can report inappropriate content or policy violations by contacting us at support@auraforcreators.com with "Content Report" in the subject line.

Investigation Process: We will investigate all reports promptly and take appropriate action, which may include content removal, account warnings, or account termination.

Appeal Process: If you believe content has been incorrectly flagged or removed, you may appeal by contacting us with "Content Appeal" in the subject line, providing detailed reasoning for your appeal.

6.5 Third-Party Compliance

Our Service integrates with third-party AI providers who maintain their own content policies. Users must comply with both our content standards and the terms of our service providers, including Higgsfield AI.

7. Payment Terms and Credits

7.1 Credit System

• Our Service operates on a credit-based system

• Credits are purchased through our platform using Stripe payment processing

• Credits have no usage limits or expiration dates

• New users receive 4 free credits upon signup

7.2 Pricing

Current pricing is $0.20 per credit. Prices are subject to change with reasonable notice to users.

7.3 Refund Policy

We generally do not offer refunds for purchased credits. Refunds may be considered only in rare cases where:

• Credits fail to generate images due to technical issues on our end

• Payment processing errors occur

All refund requests must be submitted to support@auraforcreators.com and will be evaluated on a case-by-case basis.

7.4 Future Subscriptions

We plan to offer subscription services in the future. Separate terms will apply to subscription offerings.

8. Disclaimers and Limitation of Liability

8.1 Service Disclaimers

Our Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or completely secure. We make no representations about the accuracy or completeness of content generated through our Service.

8.2 Third-Party Services

Our Service relies on third-party providers. We are not responsible for the availability, functionality, or policies of these third-party services, though we make reasonable efforts to work with reputable providers.

8.3 Limitation of Liability

To the maximum extent permitted by law, Aura for Creators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use.

Our total liability for any claims arising from these Terms or your use of our Service shall not exceed the amount you paid us in the 12 months preceding the claim, or £100, whichever is greater.

Mandatory Liability: Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.

8.4 Consumer Rights (UK/EU)

UK Consumer Rights: If you are a consumer in the UK, you have rights under the Consumer Rights Act 2015 and other consumer protection legislation that cannot be excluded by these Terms.

EU Consumer Rights: If you are a consumer in the EU, you have rights under applicable consumer protection directives that cannot be waived by these Terms.

Digital Content Rights: As our Service involves digital content, you may have specific rights regarding the quality, functionality, and conformity of our Service under applicable consumer laws.

You agree to indemnify, defend, and hold harmless Aura for Creators from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt arising from:

• Your use of the Service in violation of these Terms

• Your breach of any representation or warranty made in these Terms

• Your violation of any third-party rights, including intellectual property rights

• Any negligent acts or omissions in your use of the Service

• Any content you submit that infringes upon the rights of others

This indemnification obligation will survive termination of these Terms and your use of the Service.

10. Account Termination

10.1 Termination by Us

We may terminate or suspend your account, with or without notice, if you:

• Breach our Acceptable Use Policy

• Fail to pay applicable fees

• Engage in conduct that we reasonably believe is harmful to other users or our Service

• Violate applicable laws or regulations in your use of the Service

10.2 Termination by You

You may terminate your account at any time by contacting us at support@auraforcreators.com. Unused credits are generally non-refundable unless required by applicable consumer protection laws.

10.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. We may delete your account and associated data in accordance with our Privacy Policy.

Sections of these Terms that by their nature should survive termination will remain in effect, including payment obligations, liability limitations, and indemnification provisions.

11. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms if such failure or delay results from circumstances beyond our reasonable control, including but not limited to:

• Acts of God, natural disasters, or extreme weather conditions

• War, terrorism, civil unrest, or government actions

• Internet outages, cyber attacks, or infrastructure failures

• Third-party service provider failures or interruptions

• Pandemics, epidemics, or public health emergencies

• Labor disputes, strikes, or other industrial actions

During any force majeure event, we will make reasonable efforts to minimize disruption to our Service and will notify users of significant service interruptions when practicable.

12. Dispute Resolution

12.1 Initial Contact

Before pursuing formal dispute resolution, please contact us at support@auraforcreators.com to discuss your concerns. We are committed to resolving issues amicably and will respond within 5 business days.

12.2 Informal Resolution Period

Both parties agree to attempt to resolve disputes through good faith negotiations for a period of 30 days before initiating formal proceedings.

12.3 Consumer Dispute Resolution

UK Consumers: You may use the UK's Alternative Dispute Resolution (ADR) services or contact Citizens Advice for assistance with consumer disputes.

EU Consumers: You may access the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr

12.4 Mediation

If informal resolution fails, both parties may agree to submit the dispute to mediation through a recognized mediation service in Scotland before pursuing litigation.

13. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Scotland and the United Kingdom.

Subject to the dispute resolution procedures above, any disputes arising from these Terms or the use of our Service shall be subject to the exclusive jurisdiction of the courts of Glasgow, Scotland.

If you are accessing our Service from outside the UK, you are responsible for compliance with local laws in your jurisdiction.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by:

• Posting the updated Terms on our website

• Updating the "Last Updated" date

• For significant changes, providing email notification to registered users

Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.
